Welcome to DesiWay! These Terms of Service ("Terms") govern your use of our South Asian marketplace platform, including our website, mobile applications, and related services (collectively, the "Service").

By accessing or using DesiWay, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Definitions

"Platform"

refers to the DesiWay marketplace, including all websites, applications, and services.

"User", "You", "Your"

refers to individuals who access or use the Platform.

"Seller"

refers to Users who list and sell products or services on the Platform.

"Buyer"

refers to Users who purchase products or services on the Platform.

3. User Accounts

To access certain features of the Platform, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

You must be at least 18 years old to create an account and use the Platform.

4. Marketplace Rules

For Sellers:

  • List only authentic South Asian products and services
  • Provide accurate descriptions and images
  • Honor all sales and deliver items as described
  • Comply with all applicable laws and regulations
  • Maintain professional communication with buyers

For Buyers:

  • Provide accurate shipping and payment information
  • Complete purchases in good faith
  • Communicate respectfully with sellers
  • Report any issues through proper channels
  • Leave honest and fair reviews

5. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

  • Violating any laws or regulations
  • Posting false, misleading, or fraudulent content
  • Infringing on intellectual property rights
  • Harassing, threatening, or intimidating other users
  • Attempting to gain unauthorized access to the Platform
  • Using automated systems or bots without permission
  • Circumventing security features or restrictions
  • Engaging in money laundering or fraudulent transactions
  • Selling prohibited or illegal items
  • Spamming or sending unsolicited communications

6. Payment Terms

All payments on the Platform are processed through secure third-party payment providers.

Transaction Fees

DesiWay charges a service fee on successful transactions. Current fee structure:

  • Marketplace fee: 5% of transaction value
  • Payment processing fee: 2.9% + $0.30

Refunds and Disputes

Refunds are handled according to our Refund Policy. Disputes between buyers and sellers should first be resolved directly. If necessary, DesiWay may mediate disputes.

7. Intellectual Property

The Platform and its original content, features, and functionality are owned by DesiWay and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

By posting content on the Platform, you grant DesiWay a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such content on and through the Platform.

You represent and warrant that you own or have the necessary rights to all content you post and that your content does not infringe on any third-party rights.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIWAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

DesiWay acts as a marketplace facilitator and is not responsible for:

  • The quality, safety, or legality of items listed
  • The accuracy of listings or user content
  • The ability of sellers to sell or buyers to pay
  • Disputes between users

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Platform will cease immediately. All provisions of the Terms which by their nature should survive termination shall survive termination.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions. Any disputes arising from these Terms or use of the Platform shall be resolved in the courts of [Your Jurisdiction].

11. Changes to Terms
